Release of Liability, Authorization Agreement
& Refund Policy

In exchange for participation in: 

  • MEAL PLAN CLUB or RECIPE CLUB referred to as "Clean Food Dirty Girl membership",
  • MEAL PLAN CLUB - TRIAL referred to as "Trial"

created by Clean Food Dirty Girl (cleanfooddirtygirl.com) and/or use of the services of Clean Food Dirty Girl, I agree to the following:   

  1. PAYMENT TERMS, FINANCIAL RESPONSIBILITY & NON-SHARING OF INTELLECTUAL PROPERTY.

Clean Food Dirty Girl

I agree to comply with the payment option I signed up for, and authorize Clean Food Dirty Girl to charge that amount to my default credit card on file on a recurring basis until I cancel, based on the product and option I have chosen for the Clean Food Dirty Girl membership:

  1. $25 monthly recurring charge (charged monthly) for Meal Plan Club membership
  2. $60 quarterly recurring charge (charged every 3 months) for Meal Plan Club membership
  3. $216 annually recurring charge (charged every 12 months) for Meal Plan Club membership
  4. $12 monthly recurring charge (charged monthly) for Recipe Club membership

By purchasing the Clean Food Dirty Girl membership, I hereby acknowledge that I have read, understand, and agree to be bound by the terms and conditions stated herein.

I agree to not share my login and content from the Clean Food Dirty Girl membership, and acknowledge that is a violation of Clean Food Dirty Girl's intellectual property.

I also acknowledge that I have represented to Clean Food Dirty Girl that payment of the Clean Food Dirty Girl membership will not place a significant financial burden on me or my family. 

Clean Food Dirty Girl Trial

If I have chosen the Trial, I will not be charged until and unless I choose to convert to a paying customer by choosing one of the four paid options above.

  1. REFUND POLICY.

If you committed to a quarterly or yearly subscription and are feeling overwhelmed, as long as you are at the beginning of the subscription (less than one month into the quarterly, less than one quarter into the yearly), reach out to us and, as a one-time courtesy, we are glad to work with you to arrange a shorter membership period.

  1. CANCELLATION PROCESS.

You may cancel your Clean Food Dirty Girl membership at any time by logging in to the membership site > Account >Update Membership > Cancel.

Email us anytime if you need assistance logging into your portal.

Cancellations are not retroactive. You must cancel before your next billing date to avoid being charged for the renewal.

Membership cancellations are generally processed immediately but please allow us up to 3 business days to process your cancellation. You will receive a confirmation email upon processing. If you do not receive a confirmation email after submitting a cancellation, contact us.

You are responsible for canceling under the account associated with your membership.

  1. DISPUTES & CHARGEBACKS.

We request that you contact us first before filing a chargeback or dispute with your credit/debit card company. We are a small team, disputes cost us time and affect our reputation with our payment processor and financial standing.

  1. ASSUMPTION OF RISKS AND RELEASE. 

I recognize that there may be risks associated with the participation in the Clean Food Dirty Girl membership or the Trial, I assume full responsibility for my current and future medical issues that may arise by participating in the Clean Food Dirty Girl membership or the Trial. I have provided full disclosure to my physician of all known medical conditions which include and is not limited to food allergies, and have been cleared by my physician prior to participating in the Clean Food Dirty Girl membership or the Trial.

I further release and discharge Clean Food Dirty Girl for medical issues, injury, loss or damage arising out of my or my participation in the Clean Food Dirty Girl membership or the Trial, whether caused by the fault of myself, Clean Food Dirty Girl or other third parties such as employees, business partners and affiliates of Clean Food Dirty Girl.

  1. INDEMNIFICATION & LIMITATION OF LIABILITY.

I agree to indemnify and defend Clean Food Dirty Girl against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my participation in the Clean Food Dirty Girl membership or Trial, and engaging in the services of Clean Food Dirty Girl. 

In the event that I am no longer able to participate in the Clean Food Dirty Girl membership, I agree to be bound by the payment terms and limitation of liability. I will only be eligible for a refund and no other legal claims can be made against Clean Food Dirty Girl, its partners or third parties associated with Clean Food Dirty Girl.

  1. NO GUARANTEE OF RESULTS. 

I agree that Clean Food Dirty Girl has made every effort to accurately represent the Clean Food Dirty Girl membership services and activities and their potential benefits. Results can and do vary; therefore, the Company makes no guarantees. 

The testimonials and examples used are not intended to represent or guarantee that I will achieve the same or similar results. Each individual's success depends on many factors, including but not limited to his or her background, dedication, using the resources in the Clean Food Dirty Girl membership, and motivation. 

  1. APPLICABLE LAW.

Any legal or equitable claim that may arise from participation in the above shall be resolved under Hawaii law of Maui County.

  1. NO DURESS.

I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.

  1. HEALTH & MEDICAL. 

I agree and acknowledge that all information presented on this website is for informational purposes only. These statements have not been evaluated by the United States Food and Drug Administration (FDA). This website is not intended to diagnose, treat, cure or prevent any disease and is not intended to be a substitute or replacement for any medical treatment and individual results may vary.

Clean Food Dirty Girl is a website dedicated to sharing our love for a whole-food plant-based lifestyle that includes minimally processed plant foods as a diet staple.

Clean Food Dirty Girl is not a medical organization and we are not health professionals. The website and the content provided on the website is not, and is not intended to be medical advice, and do not provide medical diagnoses or treatments for health conditions.

I further acknowledge that Clean Food Dirty Girl and its affiliates, employees, and guests are not qualified to provide medical advice, and the information provided to me by them is not intended as such. I agree to seek the advice of a healthcare professional for my specific health concerns, which include but are not limited to recipes and advice provided by any member of Clean Food Dirty Girl's staff.

  1. ARM'S LENGTH AGREEMENT. 

This Agreement and each of its terms are the product of an arms' length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular Party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity. 

  1. ENFORCEABILITY.

The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.    

  1. TERMS OF USE AND PRIVACY POLICY. 

This release of liability shall include the terms of use and privacy policy on and for our website www.cleanfooddirtygirl.com.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT.     

I FURTHER UNDERSTAND THAT BY SUBMITTING PAYMENT OR BY REQUESTING A TRIAL, I AM SIGNING THIS RELEASE AND I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
